Business Terms and Conditions (AGB)

A. ONLINE-SHOP

1. Scope of Validity

By submission of an order, the purchaser or party submitting the order, the event or course participant (hereinafter referred to as "customer") herewith expressly agrees to the General Terms an Conditions and expressly agrees to the data storage archiving and data processing by Code Brew Beans according to Section 15 of these General Terms and Conditions. All sales and deliveries shall be settled by Code Brew Beans only on the basis of these General Terms and Conditions. Deviating and / or supplementary agreements require explicit written consent of Code Brew Beans. These provisions shall also apply mutatis mutandis to all event and course offers.

2. Orders and Deliveries

By placing an order, the Customer acknowledges and accepts our terms of delivery and payment. Delivery is usually dispatched within 1 to 3 working days after receipt of payment. There is no minimum value order. Any restrictions on the assortment range of products are expressly reserved.

3. Prices, Delivery and Shipping Costs

The prices include Value Added Tax (VAT). Shipping costs are not included in the quoted prices; they will be charged additionally.
For deliveries to locationswithin SwitzerlandCustomers will be charged a shipping cost of at least CHF 7.00. With an order value of CHF 60.00 or higher, no shipping costs will be charged. However, special requests (e.g. express shipments) will always be invoiced separately.
For deliveries to locations outside of Switzerland Customers will be charged the actual shipping costs. With an order value of CHF 60.00 or higher, no standard shipping costs will be charged. However, special requests (e.g. express shipments) will always be invoiced separately. Shipment of goods abroad may also incur customs charges. These shipping costs shall also be charged to the "customer."

4. Payment
We accept MasterCard, Visa, PostFinance Card, Twint and PayPal. For payment by credit card or PostFinance Card, the total amount of the order and shipping costs / customs costs will be charged on the day of receipt of the order. In the case of credit card payments, the "customer" is automatically forwarded online to the payment provider of Code Brew Beans after completion of the order in our shop. The "customer" records the credit card data on a secure connection directly on the homepage of this payment provider. No credit card data is stored by Code Brew Beans. The card of the "customer" will be charged an amount including the shipping charges / customs charges and VAT.

5. Returns
Items which have been delivered are not be eligible for return. In the case of obvious defects, the purchase price is reduced, or upon special request of the "Customer" a replacement delivery shall be completed.

6. Claims
The quality of the delivered goods must be inspected immediately upon delivery by the "customer." After the expiry of 5 days from the day of the receipt of goods, the delivery shall be accepted as approved. For damages resulting from improper storage and / or improper use or no replacement of goods shall be permitted.

7. Liability
Code Brew Beans assumes no liability upon assumes no liability for non-delivery or late delivery of products due to an incorrectly declared delivery address, absence of the recipient and / or customs problems (export).
B. ADDITIONAL CONDITIONS FOR EVENTS AND COURSES
8. Registration
The registration for events or courses takes place in writing (e.g. letter, e-mail or directly online via the Internet platform of Code Brew Beans  / " www.codebrewbeans.ch" and will be confirmed by e-mail upon receipt.

9. Closing date for registration
As a general rule, the closing of application takes place one week before the event or start of course.

10. Completion of registration
After registration, Code Brew Beans decides whether the course will be held on the basis of the number of participants (minimum number of participants). Code Brew Beans reserves the right to cancel events if the minimum number of participants is not reached or the performance is not possible due to force majeure. Payments completed by the customer in such cases shall be refunded or upon special request of the customer applied to another course offered by www.turmkaffee.ch.

11. Cost/Payment terms
The costs for participation of the customer in courses or events are listed in the documentation for each course or event. At the latest one week before the start of the event or the course, the invoice is usually sent along with the course confirmation. The costs for the events or courses must paid by the beginning of the course or the event.

12. Cancellation, Withdrawal or Discontinuation
Cancellations must be processed (formally), in every case, by e-mail to info@codebrewbeans.ch or by calling 079 7996822. Unless otherwise notated in the course or event description or on the course or event confirmation, the following rules shall apply:
Up until a week before the event or course start, an activity fee will be charged to the customer in the amount of CHF 100.00.
In the case of cancellation by the customer up to 3 days before course or event start, the customer must pay 50% of the course or event cost fee. For cancellations taking place after 3 days before start of the course of event, then the customer must pay the entire event or course cost fee.
Upon cancellation after begin of an event or of the course, by non-attendance of the event or the course by the customer, the entire event or course fee must be paid.

13. Insurance
Insurance is the concern of the customer participating in the event or course.  Code Brew Beans shall refuse any and all liability for injury and damages to person or property. It is recommended to the customer to obtain course or cancellation insurance.

14. Changes to event and course offerings, incl. price changes
A change to the event and course offerings, incl. price changes shall remain reserved.
C. DATA PROTECTION AND FINAL PROVISIONS
15. Data Protection / Consent of the customer to data processing
15.1.  Code Brew Beans uses personal data of the customer which were used to complete registration for event or the course to create a customer file. We process and store customer personal data with great care and according to all Swiss and European data protection laws.

15.2. The customer herewith declares acceptance of the General Terms and Conditions , that the personal data submitted (Name, Surname, Date of Birth, Address, e-mail address, telephone and mobile numbers of the customer as well as data about purchasing history, frequency, type and quantities of purchased products and/or courses and/or events as well as use of benefits and perks) may be stored within the customer data of Code Brew Beans and used by Code Brew Beans for the following purposes:
a) for completion of ordering and payment processes between Code Brew Beans and the customer within the framework of individual orders or within the framework of an annual subscription service ordered by the customer;
b) for completion of events or courses and the ordering and payment processes between Code Brew Beans and customer in connection with the booked courses or events of the customer;
c) for customer service as well as for marketing- and commercial purposes, including direct marketing;
d) for analysis of purchasing history of the customer (incl. frequency, type and quantity of the purchased produces and/or booked courses and/or events as well as incl. the utilization of benefits and perks) for commercial and research purposes as well as for static evaluation of customer behavior and history;
e) for completion of shopping cart analyses that reflect customer history and behavior;
f) in order to send customer electronic or written news with special offers ;
g) for distribution of data to third parties both domestically and abroad exclusively according to strict, contractual data protection provisions on the basis of legal provisions or for carrying out authorized interests of Code Brew Beans. Transfer to third parties abroad shall only take place in the case that there are data protection laws which are equivalent to the data protection laws in Switzerland (and in the case of personal data of EU customers, equivalent data protection laws as in the EU) such that data protection is guaranteed by law and by contract. Recipients of personal data may also be companies which, for example, complete shopping cart analyses or mass distribution to customers on a contractual basis by Code Brew Beans.

15.3. The personal data according to the following paragraphs 15.2 of these General Terms and Conditions will be stored by Code Brew Beans as long as the customer who requires this authorization or omission according to paragraph 15.4 a) of these General Terms and Conditions, or whose consent is withdrawn according to paragraph 15.2 a) through to g) these General Terms and Conditions, in whole or in part. (i.e. compare also paragraph 15.4 b) of these General Terms and Conditions).

15.4. The customer can request information about his or her customer data at anytime from the data archived by Code Brew Beans as well as authorization or as given certain
a) prerequisites the omission or deletion of data by submitting an official identification document to prove the identity of the customer and
b) to withdraw consent according to the aforementioned paragraphs 15.2 a) through to b) these General Terms and Conditions, in whole or in part.
c) To the extent that these legal provisions are fulfilled, the customer has, additionally, the right to limitation of data processing, a right to data transfer, a right to disagree with data processing and a right to submit complaint to supervisory authorities.
d) In the case of full withdrawal of consent by the customer according to paragraph 15.2 a) through to g) these General Terms and Conditions – i.e. related to the extent that this withdrawal, for example, not only the sending of messages and special offers (cf. paragraph 15.2 b) and f)) –if Code Brew Beans rescinds this continuation of the customer relationship, given that the provision of this data is required by law or for a completion of contract or if a completion of contract is required.
e) In the case that a full or partial withdrawal of consent is authorized by the customer according to paragraph 15.2 a) through to g) these General Terms and Conditions, Code Brew Beans shall delete and anonymize the personal data of this customer in the scope of the withdrawal. In the case that this data is anonymized, this data is processed in such a way that no inference can be made to the individual person of the customer. This anonymized data may continue to be used for research purposes and for the purpose of statistic analysis of customer behavior, i.e. of all customers, by Code Brew Beans, also after the withdrawal of consent.

17. Changes to these General Terms and Conditions

Code Brew Beans reserves the right to make changes to these General Terms and Conditions. These General Terms and Conditions, in their current version and as amended, are published on the homepage of  e-commerce (www.codebrewbeans.ch). As of the time of publication, the customer accepts changes to these General Terms and Conditions only to the benefit of the customer and/or to the extent that acceptance does not disadvantage the customer. In all remaining cases, the following version of these General Terms and Conditions as of the first order of the customer or after the first event or course registration of the customer shall apply according to the publication of these amended General Terms and Conditions onto the aforementioned homepage of Code Brew Beans.

18. Applicable law and place of jurisdiction
18.1. To the extent that the law of another country's jurisdiction or the jurisdiction of the European Union is not compulsorily applicable, the following provisions of the Swiss material law (including UN sales law) agreements and customer relationship between Code Brew Beans and the customer shall apply, even if orders are made from the other country or if goods have been delivered to the other country, i.e. courses or events have been booked from the other country and/or have been completed in the other country.

18.2. With reservation to the law of other mandatory legal venues, the legal venue of Riehen, Switzerland shall be agreed in relation to any disputes arising from the contract or the customer relationship between Code Brew Beans and the customer.

19. Severability Clause
Should one of the terms contained in these General Terms and Conditions be or become invalid, the validity of the contract shall remain unaffected. Verbal agreements shall be null and void and require the written form for validity.
